1. Overview
These Terms of Use ("Terms") govern your access to and use of the Harvey Creative Consulting LLC ("Company", "we", "us") website, survey platform, and related services (collectively, the "Services").
By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
2. Who May Use the Services
You may use the Services if you:
- Are at least 18 years old (or the age of majority in your jurisdiction)
- Have authority to use the Services on behalf of your organization (if applicable)
- Agree to comply with these Terms
3. Types of Users
3.1 Survey Respondents
Individuals completing surveys without creating an account.
3.2 Company Users
Authorized representatives of organizations with access to survey results and reports.
3.3 Administrators
Internal users managing the platform.
4. Survey Participation
4.1 No Guarantee of Anonymity
- Surveys do not require your name or email
- However, responses are not fully anonymous
- Technical data (e.g., IP address) may be collected
- Responses may be visible to the company sponsoring the survey
4.2 User Responsibility
You are responsible for the content you submit, including free-text responses.
Do not include personal identifying information or sensitive and confidential information if you do not wish it to be seen by your organization.
5. Use of the Services
You agree not to:
- Use the Services for unlawful purposes
- Submit false, misleading, or harmful information
- Attempt to interfere with or disrupt the Services
- Access data you are not authorized to access
- Reverse engineer or attempt to extract source code
6. Company Access to Data
If you complete a survey:
- Your responses may be shared with the sponsoring company
- Companies may access individual responses, including written answers
- We are not responsible for how companies use or interpret survey data
7. Accounts
7.1 Account Security
If you create an account, you are responsible for:
- Maintaining the confidentiality of your credentials
- All activity under your account
7.2 Account Management
We may suspend or terminate accounts that violate these Terms.
8. Intellectual Property
All content and materials in the Services, including:
- Software
- Reports
- Designs
- Text and graphics
are owned by or licensed to Harvey Creative Consulting and protected by applicable laws.
You may not copy, modify, or distribute our content without permission.
9. Data and Privacy
Your use of the Services is also governed by our Privacy Policy.
10. Third-Party Services
The Services may use third-party tools, including Google Analytics.
We are not responsible for third-party services or their practices.
11. Disclaimers
The Services are provided "as is" and "as available."
We make no guarantees regarding:
- Accuracy of survey results or insights
- Business outcomes based on reports
- Availability or reliability of the Services
12. Limitation of Liability
To the maximum extent permitted by law, Harvey Creative Consulting shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, revenue, or business opportunities
- Actions taken by organizations based on survey results
13. Indemnification
You agree to indemnify and hold harmless Harvey Creative Consulting from any claims arising from:
- Your use of the Services
- Your submitted content
- Your violation of these Terms
14. Termination
We may suspend or terminate access to the Services at any time, with or without notice, if you violate these Terms.
15. Changes to the Services
We may modify or discontinue any part of the Services at any time without liability.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles.
